Terms of Use

Last updated: 3 October 2026

These Terms of Use apply to your use of the FatigueManagement.co.uk website.

The website is operated by Learning Gateway Ltd (“we”, “us” or “our”).

By using this website, you agree to these terms. If you do not agree with them, please do not use the website.

FatigueManagement.co.uk provides information, guidance and educational material relating to fatigue management, shift work, fatigue risk assessment, fatigue risk modelling and related operational topics.

We also provide information about fatigue-management software and related services.

The educational content and the software are distinct. These Terms of Use govern the public website. Section 15 sets out the terms of a Fatigue Management Workspace subscription. Taxes are applied where legally required.

Content published on this website is provided for general information and educational purposes.

It is not intended to constitute:

  • legal advice;
  • regulatory advice;
  • medical or occupational-health advice;
  • a site-specific or organisation-specific fatigue risk assessment;
  • confirmation that a particular working pattern is safe or compliant; or
  • a substitute for competent professional judgement.

Fatigue-management requirements can depend on the sector, activity, contractual arrangements, applicable legislation, standards and an organisation’s own policies.

You should consider the circumstances relevant to your organisation and obtain competent advice where appropriate.

Our educational resources are intended to help users develop a better understanding of fatigue risk, fatigue-management principles, modelling approaches and relevant guidance. They do not, by themselves, establish that a person is competent to make fatigue-management decisions in a particular operational context.

3. Fatigue models and calculated information

Section titled “3. Fatigue models and calculated information”

Some content on this website discusses fatigue models, including Fatigue Index, Risk Index and approaches derived from published fatigue research.

Modelled outputs are estimates based on defined inputs and assumptions. They do not measure an individual’s actual alertness, fitness for duty or ability to work safely.

No model score or threshold should be treated, by itself, as proof that a person or working pattern is safe, unsafe, compliant or non-compliant.

The website may refer to legislation, regulator guidance, research publications and industry standards.

We aim to distinguish between legislation, regulatory guidance, industry standards, organisational policies and modelling methodologies.

References to an external standard or publication do not mean that:

  • the standard applies to every organisation or activity;
  • we are affiliated with its publisher;
  • the publisher has approved or endorsed this website or our software; or
  • our summaries replace the original source.

Where a requirement may apply to your work, you should consult the current official source.

We take reasonable care when preparing and maintaining content, but fatigue-management guidance, legislation, standards, research and industry practices can change.

We do not guarantee that every page will always be complete, current or applicable to your particular circumstances.

Where available, publication or review dates indicate when material was last substantively reviewed. They do not guarantee that no relevant change has occurred since that date.

If you identify an error or outdated reference, you are welcome to contact us.

You may use the website for lawful personal, professional and internal business purposes.

You must not:

  • misuse or interfere with the operation or security of the website;
  • attempt to gain unauthorised access to systems or restricted areas;
  • use automated methods in a way that places an unreasonable load on the website;
  • knowingly introduce malicious software or harmful material;
  • misrepresent our content as official guidance from a regulator or third party; or
  • use our branding in a way that suggests an affiliation or endorsement that does not exist.

Unless otherwise stated, the website’s original text, design, branding, graphics, software and other original material are owned by or licensed to Learning Gateway Ltd.

You may quote reasonable extracts for legitimate purposes such as commentary, research, internal business use or reference, provided appropriate attribution is given and applicable copyright law is respected.

You may not reproduce substantial parts of the website, republish our content as your own, or commercially redistribute our original material without permission.

Third-party publications, standards, legislation, research and trademarks referenced on this website remain the property of their respective owners.

The website contains links to third-party websites and publications, including regulators, government bodies, research organisations and other external sources.

These links are provided for reference and convenience.

Fatigue Management software is intended to provide a practical aid to organisations and individuals who understand fatigue risk and are responsible for managing it.

The software is designed to support informed human decision-making. It can help users assess roster-related fatigue exposure, apply defined organisational policies, identify issues requiring review, record decisions and maintain supporting information.

Fatigue-management decisions should ultimately be made by people with an appropriate understanding of fatigue, the relevant operational circumstances and the requirements that apply to their organisation.

A significant purpose of the educational resources published on FatigueManagement.co.uk is to help users understand the principles that sit behind the software, including fatigue risk, shift-work factors, fatigue models, their limitations and the distinction between model outputs, organisational policies and wider management judgement.

Those resources are intended to support learning and informed use of the software. They do not replace appropriate training, experience, organisational procedures or competent professional advice where these are required.

The software should therefore be treated as a decision-support tool, rather than as the decision-maker itself. Model outputs, warnings, classifications and policy results should be interpreted in context by appropriately informed users.

Nothing on the public website or within the software should be interpreted as a guarantee that use of the software will:

  • ensure regulatory or contractual compliance;
  • prevent fatigue-related incidents;
  • make a roster or assignment safe;
  • determine whether an individual is fit for duty;
  • establish that a person is competent to manage fatigue; or
  • remove the need for appropriate human judgement, risk controls and management oversight.

A paid Fatigue Management Workspace subscription is governed by the Workspace Subscription Terms.

We aim to keep the website available and functioning correctly, but we do not guarantee uninterrupted or error-free access.

We may change, suspend or withdraw any part of the public website where reasonably necessary, including for maintenance, security or improvements.

Nothing in these terms excludes or limits liability where it would be unlawful to do so.

Subject to that, the website is provided for general informational purposes and you remain responsible for decisions made in reliance on information relevant to your organisation, workers or activities.

To the extent permitted by law, we are not responsible for loss arising solely from reliance on general website content where appropriate professional, regulatory or organisation-specific assessment should reasonably have been undertaken.

Our collection and use of personal information is described in our Privacy Policy.

Where cookies or similar technologies require a choice, information about those technologies and available controls is provided through our cookie and privacy arrangements.

We may update these Terms of Use from time to time.

The latest version will be published on this page with an updated review date.

These terms are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction in relation to disputes concerning use of this website, subject to any rights that cannot lawfully be excluded.

A paid Fatigue Management Workspace subscription is governed by the Workspace Subscription Terms.

Those terms cover the price, managed-worker quantity, renewal, cancellation, restricted access after the paid period, and retention of workspace data. These website Terms of Use do not set the subscription price.

If you have questions about these terms, the website or our published material, please contact us using the details on our Contact page.
